INTRODUCTION

This Currax Pharmaceuticals LLC (“Currax”) Consumer Health Data Privacy Notice (“Notice”) supplements our Privacy Policy which describes our general data practices and explains our practices for processing “consumer health data” as defined by applicable U.S. state laws (“consumer health data”).

CATEGORIES OF CONSUMER HEALTH DATA WE MAY COLLECT

We may collect the following categories of consumer health data:

  • Medical, physical and mental health conditions, and biometric information;
  • Information that could identify an attempt to seek health care services; and
  • Inferences of the above categories of consumer health data derived or extrapolated from other information, such as cookies and other tracking technologies on our websites and mobile apps (if you provide your express permission for our collection).

SOURCES OF CONSUMER HEALTH DATA

We may collect consumer health data from the following categories of sources:

  • Directly from you when you provide it to us in conjunction with your interactions with our products and services;
  • Through our websites and mobile apps if you provide permission for the collection of consumer health data by us and our business partners, and
  • With your permission, we and our business partners may collect your health data over time and across different internet websites or online services when you use any internet website or online service of the regulated entity; and
  • From our business partners, with your permission, or acting at your request.

PURPOSES FOR PROCESSING CONSUMER HEALTH DATA

We collect and use your consumer health data for the following business purposes:

  • To provide patient assistance, prescription discounts and reimbursement support programs;
  • To communicate information about diseases, products and services through our websites, via e-mail, direct mail and other channels;
  • To offer educational programs related to health-conditions, publications, and tools;
  • To conduct quality assessment and improvement activities, e.g., through patient surveys or questionnaires;
  • To audit our programs and resources for compliance and security purposes;
  • To investigate and respond to potential health and safety issues;
  • To comply with our legal and regulatory obligations;
  • To establish or defend a legal claim; and
  • For any other purpose required or allowed under applicable law.

REASONS WE MAY DISCLOSE CONSUMER HEALTH DATA

We may disclose consumer health data as follows:

  • To regulatory agencies that regulate our operations and products in conjunction with our legal obligations or other compliance requirements;
  • To our service providers that process consumer health data on our behalf. Our agreements with our service providers include detailed data protection requirements and limit their processing of consumer health data on our behalf to what is strictly required to provide services to us;
  • To our business partners with whom we jointly offer products or services, and/or to provide you with a product or service you have requested;
  • To our affiliated companies, for example, for our administrative purposes, IT management, or for them to provide services to you or support and supplement the services we provide; and
  • As required by applicable law.

RETENTION

Consistent with the disclosures in our Privacy Policy, we will retain and use consumer health data for the length of time needed to carry out the purposes outlined in this Notice and in accordance with our record retention policies.

CONSUMER RIGHTS

If you are a consumer in a state with laws specifically offering privacy rights specific to consumer health data, subject to certain exceptions, you may have certain rights related to your consumer health data, including:

  • Right to Access. You have the right to confirm whether we are processing your health data and to access your health data.
  • Right to Withdraw Consent. If we collect, use, or share your health data based on your consent, you have the right to withdraw such consent.
  • Right to Delete. You have the right to request that we delete health data that we maintain about you.

Please note, we will verify your identity as permitted or required under applicable law before we process your request.  If we believe we need further information to verify your request, we may ask you to provide additional information to us. In some cases, we may be unable to fulfill your request. If your rights request is denied, applicable law may give you a right to lodge an appeal with us.
